Terms of Service

These terms govern your use of Lingomatic ("the app"), a Shopify application for AI-powered store translation operated by HeaStudio OÜ ("we", "us", "our"). By installing the app, you agree to these terms. You must be at least 18 years old to use this service.
1. Service Description
Lingomatic translates your Shopify store content into multiple languages using AI models. The app syncs your store content, generates translations, and publishes them back to your Shopify store.
2. Account and Access
- You must have a valid Shopify store to use Lingomatic.
- You grant Lingomatic the necessary Shopify API permissions to read your store content and publish translations.
- You are responsible for the content you translate and for reviewing translations before publishing.
3. Acceptable Use
You agree not to:
- Use the service to translate content that is unlawful, defamatory, or infringes on third-party intellectual property rights.
- Attempt to reverse-engineer, scrape, or extract data from the service beyond its intended use.
- Resell, sublicense, or redistribute translation words or access to the service.
- Use automated tools or scripts to interact with the service outside of the Shopify app interface.
- Intentionally submit content designed to exploit, manipulate, or probe the underlying AI models.
- Use the service in a way that impairs its performance or availability for other users.
4. Words and Billing
- Translation usage is measured in words. Each plan includes a monthly word allowance.
- Lingomatic automatically selects the best AI model for each translation. We may adjust word rates at any time to reflect changes in underlying AI provider costs.
- Additional words can be purchased as one-time packages.
- Monthly words reset at the start of each billing period and do not roll over.
- Purchased word packages do not expire.
- All billing — subscriptions and word package purchases — is processed through Shopify's billing system in USD and charged to the payment method on file in your Shopify account.
5. Pricing Changes
- We reserve the right to modify subscription pricing, plan structures, word allowances, and word rates at any time.
- Changes to subscription pricing will take effect at the start of your next billing period. We will provide at least 30 days' notice before subscription price changes take effect.
- Word rate adjustments may take effect immediately, as they reflect changes in third-party AI provider costs.
- Purchased word packages are not affected by subsequent rate changes — you will always receive the number of words you paid for.
6. Refunds
- Subscription fees are non-refundable. If you cancel your subscription, your plan remains active until the end of the current billing period. Subscription refunds are handled by Shopify in accordance with their billing policies.
- One-time word package purchases are non-refundable, except in cases of verified technical errors (e.g. duplicate charges, words deducted but translation not delivered due to a system fault).
- To request a refund for a technical error, contact us at support@lingomatic.io within 30 days of the charge. Include your store domain and a description of the issue.
7. Translation Quality
- Translations are generated by AI models and may contain errors or inaccuracies.
- We recommend reviewing translations before publishing, especially for legal, medical, or safety-critical content.
- We provide tools (glossary, brand voice, side-by-side editor) to help you refine translation quality.
- We do not guarantee that translations are error-free or suitable for any specific purpose.
8. Data Processing
By using the app, you acknowledge that your store content will be sent to third-party AI model providers for translation. See our Privacy Policy for details on data handling, sub-processors, and your rights.
9. Intellectual Property
- You retain ownership of your original store content and the translations generated for your store.
- We retain ownership of the Lingomatic application, its code, design, and infrastructure.
10. Indemnification
You agree to indemnify and hold Lingomatic harmless from any claims, damages, or expenses arising from: (a) your use of the service, (b) content you submit for translation, (c) your violation of these terms, or (d) your violation of any third-party rights, including intellectual property rights.
11. Limitation of Liability
- Lingomatic is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We are not liable for translation errors, lost sales, or damages resulting from incorrect translations.
- Our total liability is limited to the amounts actually paid by you for the service in the 12 months preceding the claim. If you are using a free plan or have not made any payments, our total liability shall not exceed zero.
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
12. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our reasonable control, including outages of third-party providers (Shopify, AI model providers, hosting infrastructure). We are not liable for any losses resulting from service interruptions.
13. Termination
- You can uninstall the app at any time through your Shopify admin.
- We may suspend or terminate your access if you violate these terms or engage in prohibited use as described in Section 3.
- Upon uninstall, your data is deleted within 48 hours as described in our Privacy Policy.
14. Changes to Terms
We may update these terms from time to time. When we make material changes, we will notify you via the email associated with your Shopify store or through an in-app notice. Continued use of the app after the effective date of changes constitutes acceptance of the updated terms.
15. Governing Law
These terms are governed by and construed in accordance with the laws of the Republic of Estonia. Any disputes arising from or relating to these terms or the service shall be resolved in the courts of Harju County, Estonia.
